Calfee Insurance Coverage Senior Counsel Tae Andrews was quoted in the July 31, 2025, Law360 Insurance Authority article, "CGL Cases To Watch In The Second Half Of 2025," which highlights several high-profile commercial general liability (CGL) insurance cases, including coverage disputes involving Meta Platforms, IBM, the Archdiocese of New York, and Red Roof Inn.
In the coverage dispute between Hartford and Chubb units and Meta Platforms, Tae weighed in on the insurers' argument that municipalities in the underlying litigation do not allege "bodily injury" covered by Instagram's CGL policies. "There's no supposed requirement that the underlying plaintiffs must have personally suffered bodily injury to trigger the CGL coverage," Tae said. He added, "If the intent was only to insure against claims brought by individuals alleging bodily injury, there'd be no need to have some of these policy limits for hundreds of millions or even billions of dollars."
Tae also commented on Liberty Mutual's denial of coverage for human trafficking suits brought against Red Roof Inn. He emphasized distinguishing between the alleged criminal acts and the policyholder's conduct. "While one never wants to discredit or downplay the severity of these alleged crimes, in terms of insurance law it's still important to pay attention to the specific actions alleged on the part of the policyholder," Tae explained. He noted that if courts deem claims under the Trafficking Victims Protection Reauthorization Act (TVPRA) uninsurable, it could have "monumental ramifications for freedom of contract and the ability of sophisticated parties to engage in risk management."
