Calfee Insurance Coverage Senior Counsel Tae Andrews was quoted in the December 4, 2025, Law360 Insurance Authority article, “‘Public Policy’ Exclusion Raises Red Flags For Insured Attys,” which covers oral arguments before the Pennsylvania Supreme Court in a coverage dispute involving insurers seeking to avoid defending a hotel accused of ignoring sex trafficking, by invoking an implicit “public policy” exclusion.

The article, written by Jennifer Mandato, quotes Calfee insurance attorney Tae Andrews, emphasizing that courts should not create judicially implied exclusions that insurers failed to include in their policies. Tae noted, “The court should not judicially create a public policy exception for [Trafficking Victims Protection Reauthorization Act] claims here because the insurers didn’t bargain for them.” He warned that such a precedent could allow insurers to invalidate coverage on extracontractual grounds, undermining the plain meaning of policy language.

Tae added that denying coverage based on undefined public policy concerns could harm victims, as insurance funds often provide critical compensation in trafficking cases. “Victims are going to suffer if defendants are deprived of insurance coverage they should otherwise have and be able to deploy to resolve all allegations against them,” he said.
