Calfee Insurance Coverage Senior Counsel Tae Andrews was quoted in the January 8, 2026, Law360 Insurance Authority article, “Wash. Climate Change Premium Suit A Sign Of More To Come.” This article covers a Washington federal court lawsuit accusing major oil companies of contributing to rising homeowners' insurance premiums - a new consumer-focused front in climate change litigation.
The article, written by Eli Flesch, examines how the proposed class action against Chevron, ExxonMobil, and other entities could impact coverage rulings in climate-related disputes. Tae Andrews commented on the potential implications for policyholders, noting that recent Delaware Supreme Court decisions in opioid-related coverage cases could signal challenges for defendants seeking insurance protection in climate litigation.
“I think, unfortunately for policyholders, the data points that we're seeing in terms of these decisions are not great in terms of the coverage perspective,” Tae told Law360. “So it will be interesting to see if the courts continue to put clamps on the scope of coverage provided for these kinds of suits, or if there's a reversal to that trend or some outlier decisions that do find coverage for these kinds of climate change suits.”
