Calfee Insurance Coverage Senior Counsel Tae Andrews was quoted in the September 11, 2025, Law360 Insurance Authority article, “OpenAI Death Suit Heightens AI Insurance Concerns,” which analyzes a wrongful death lawsuit filed against OpenAI and its CEO alleging that the artificial intelligence tool encouraged self-harm and suicidal ideation and helped a minor plan their death. The case has insurance experts evaluating potential carrier involvement and asking if creators of AI platforms have adequate coverage.
In the article written by Jennifer Mandato, Tae commented on the rising concerns for policyholders related to AI and the potential for notable interpretations of product liability claims if coverage disputes were to result from this or similar wrongful death lawsuits. "'When we think of product liability, we typically think of tangible products that you use in your kitchen or in your garage,' he said. 'Here we have a tech product, but yes, nonetheless, it is a product.'"
"For AI companies, there may be more policy tailoring to ensure they get the coverage they think they're buying, but the mechanics of how the Raine suit plays out will still be interesting to see, he added."
