Josh Friedman, a partner in Calfee’s Intellectual Property practice group, was quoted in a recent Columbus Jewish News article titled “IP Law Gray Areas May Develop in Age of AI,” written by Noell Wolfgram Evans.
The article examines the changing relationship between intellectual property law and artificial intelligence, emphasizing the legal ambiguities regarding ownership, fair use, and derivative works generated with generative AI tools.
“AI can create some impressive things, but it lacks soul. It’s a tool, but human creativity is still there,” Josh said. He emphasized that while AI models rely on vast amounts of data, the legal framework around fair use and derivative works remains unsettled. “A lot of this (legally) is still in flux. There are several court cases under review, but there’s not any uniform legal guidance yet,” he noted.
Josh also addressed the U.S. Copyright Office’s stance on AI-generated content, stating, “The U.S. has taken a hard stance that AI cannot be an inventor, but you can use AI as part of your process.” He added that only works created by humans are eligible for copyright protection.
Looking ahead, he cautioned that legal clarity may take time. “I think it may take more than a couple of years, but any new tool takes time to understand,” Josh stated, pointing to the broader implications for creators, businesses, and legal professionals navigating the AI landscape.
