On August 6, 2026, Calfee Senior Counsel Tae Andrews presented a webinar with Stafford, “Insurer Duty to Defend Civil Investigative Demands: Reexamining Coverage Assumptions After Cigna v. XL Specialty Insurance.”

The webinar focused on the evolving legal landscape surrounding insurance coverage for civil investigative demands (CIDs), government subpoenas, and other investigative actions, with a focus on recent developments involving False Claims Act (FCA) investigations. Tae and fellow panelists discussed how courts are reassessing long-held assumptions about whether government demands constitute a "claim" alleging a "wrongful act" under D&O, E&O, professional liability, and similar insurance policies.

Additional learning objectives:

  • Understanding how courts determine whether a civil investigative demand, subpoena, or similar government action constitutes a covered claim.
  • Evaluating the impact of recent False Claims Act decisions on insurance coverage analyses.
  • Identifying key policy language in D&O, E&O, professional liability, and related insurance policies that may affect coverage for government investigations.
  • Developing practical strategies for managing insurer communications, preserving privilege, and advocating for coverage while responding to government inquiries.
