Situation Summary:
Calfee was hired by a national cinema distribution company in its dispute with the developers of a shopping center.  The developers had convinced the distributor to relocate its lease to another site by fraudulently misrepresenting the development prospects of the new site, leading to the distributor being excluded from the shopping center.

Calfee Approach:
After the trial court initially granted summary judgment to the developer, the Court of Appeals reversed and remanded for trial, and Calfee tried the case to a jury verdict.

Resolution:
The jury returned a verdict in favor of the distributor for $9.5 million, reduced by the trial court to $8.5 million.  The award was affirmed on appeal and paid (including interest) by the developer to Calfee’s client.
