409A Regulations Are Here
Section 409A of the Internal Revenue Code restricts deferral elections, distribution elections and distribution events under nonqualified deferred compensation plans. If a plan is subject to Section 409A but does not comply with the applicable restrictions, participants will be taxed on their vested benefits, suffer an additional 20 percent tax and may also incur interest charges. The deadline to comply is December 31, 2007.
